Help with eBay guys (seller sent the wrong item)

Ok, I won Silent Hill 2 from this seller on eBay.com, and s/he sent me the wrong item (some shitty old movie).
I emailed the person about it a week ago and they said that they will send me the game asap via first class mail.
I haven't got the item yet, and the seller hasn't answered my email in the last 3 days. I am getting annoyed.
I am thinking of opening a dispute through eBay or Paypal, but the seller has a tracking number for the last
item, so he may win the case. I don't know what I can do in this unusual situation (in my case). Any tips would
be appreciated.

Does the tracking number show that it's waiting on information from the seller, i.e., has it been shipped yet? If it hasn't then I'd open a dispute and include that specific fact in the dispute details. They may ask you to wait a few days longer, though, just to make sure it hasn't gotten caught up somewhere.

You can also try and send the seller a last chance message, something like, "I've been trying to get a hold of you for a few days now, and I haven't heard a response. Please let me know this is at least being worked on, before I file a dispute which would make both our lives miserable."

Or something like that. Either way, good luck.

The tracking says that "item has been delivered." But this tracking is for the wrong item that s/he sent me.

Yeah, I always ask questions and stuff before I buy an item, so I don't get ripped off. But this case was an unusual one. I think I will wait till the end of the day and if no reply, I will go ahead and open a dispute.

It is a holiday, so keep that in mind. I didn't receive any mail today and I know a lot of ebay sellers don't operate at all on holiday weekends.

I'd give him a little time... but not too much. You have 45 days in which to file a dispute after which it becomes impossible. Once the dispute is started though there's no real time limit. So you can wait awhile to give him the benefit of the doubt, then file and have plenty of time to resolve the issue.

I agree with others about contacting him and saying that you'll be contacting eBay shortly if you don't get confirmation on having the correct item sent.

You said he's already acknowledged that he sent you the wrong item in eBay messages so if he tries to cop out and say he already sent the item you've got proof for the whole thing.

Something similar to me actually happened like last month, I got a DVD about raising happy babies instead of Marvel Land. The seller was pretty upfront and apologetic about the whole thing though and I got the item eventually, just a bit later than expected.

Damn it just file the dam case already. I hate nothing more on eBay than unresponsive sellers, mainly when you buy from them.

This has happened to me. I usually give the seller 24 hours to respond and then I file a dispute right away. If the seller does not respond to the dispute, you will get your money reimbursed. Rather than face the wrath of EBAY (Oh how weak you are sometimes!), they often times will take the loss and either refund you the money or send you the correct item. In either case, it's their fault!

Don't be a nice guy! Kick him in the @55 for being a douche! And when you get the item, you always have the option of giving feedback as you see fit! :boxer:

Don't really think he was a scammer in that he purposely sent out the wrong item to everyone to collect lots of monies. I would guess that he just fucked up and mixed up the labels for a couple of packages, the result of which you can see above.

Doesn't change anything from your perspective though. File a case and get your money back.

Yeah, he screwed up by not responding to email though. Then again, if I shipped out that many packaged to the wrong place I'd want to stick my head in a hole somewhere for a few days.

As far as I know ebay's buyer protection does provide an option like "Recevied the wrong item". I'd give it a shot.

This is why i always check feedback before buying anything. Things happen so i can forgive a few bad ones, so long as the vast majority of his transactions are good(especially recent history).

However, if theres a sprinkling of bad feedback through-out, then no sir.

1) Opened a dispute with Paypal, and described the situation and gave them all the evidence (snaps of our email exchange, snap of his 'about me' page, and feedback).
2) Sent him an angry email.
3) Reported him to ebay.
4) Left him negative feedback

Sounds like exactly what I'd do, but I never leave feedback until everything is resolved and I've got my money back.

You can't really go by that; a few years back I bought a few MD games from a Power Seller on Ebay - had next to no negative feedback and had plenty of good feedback. I got an email a day after from him saying he had shipped the games and I left it at that.

A week later, no games. Checked his profile on Ebay, and he had gone nuts - about 35 other people had been scammed by him; some got their items, but in poor condition, most didn't get anything. Something's just come down to luck; if a seller's out to con you, he's gonna con 'ya.
