So the best way is distribute the rom to the players enjoy this game without problems.

The problem is with so many people having hands in the pot now and knowing about it (Factor 5, retrospiel, Disney, BeaglePuss) if the rom was just "magically leaked" it would be pretty easy to determine who the leaker was. Because of this, I doubt anyone just wants to let it out for fear of being sued by another entity.
I like protos too, but I'm not going to ask someone unwillingly open themselves up to the possibility of being sued into oblivion over it unless they want to take that chance themselves. That's actually one reason why I'm really impressed with Mad Moham who bought the Putty Squad proto (at his own cost) and just dumped it despite other people trying to make claim over it.

When has anyone been sued & convicted for leaking a 20 year old unreleased game? Truth be told I dont think Disney / Factor5 would of done anything.
I'm sure it would cost more to sue over this than whatever profit could be generated by the game.
But at this point the prototype has passed through enough hands that if it suddenly popped up online it would be pretty difficult to say who dumped and uploaded it, assuming they covered their tracks when they uploaded it.
I think it's more about respecting the wishes of the original developers, though, than fear of a lawsuit. Hopefully there's a plan in place to get it released if years and years go by and it gets forgotten again.
Disney/F5 probably wouldn't have done anything had the Rom leaked but now that people are trying to make money off the Rom to sell and distribute of course they'll keep a closer eye on things, no matter how small the item disney ain't gonna let someone make cash off of It without them getting the majority of the money. Remember Disney doesn't let bakeries use their characters and regularly send cease and desist letters, you think they'll let someone sell an indiana Jones game without their involvement?
Jim Valentino is currently suing rosecolored gaming for releasing the shadowhawk proto in some carts. 2 million and well in my eyes he could win, although not for that much.

Yeah well those guys were trying to make a profit off an unreleased game. Much bigger difference then just dumping a rom image of it into the wild anonymously.
Totally understand and yeah I can see why someone would get hot over Wolf3D beta as it was, but that sadly is where we're at on stuff now. If someone wants to profit of someone else's work and give no cut or fair recognition, if you don't have some good lawyers to back you up, you're screwed. Sure bootlegs are justifiable, hell I own just a few of them and got a MVS 161-in-1 over the weekend, they save money, and some people are even pirate collectors so there's the fun in that too. Thing is the argument by some that it hurts no one is crap, sure maybe the company isn't making anything on it now (or for now) but whoever did that chop shop job making it english (from Japanese for example) and the one who did the re-write aren't going to be so inclined to do it again if they get robbed which perhaps could be related to that Hybrid Front issue. The one other thing I dislike it the lie of calling this shit repro, sorry, it's a bootleg, it's warez in a pretty wrapper with a sticker put on top.
I personally reserve the euphemism "reproduction" for games put on carts (possibly with new manuals/boxes) for territories in which it was never originally officially released, like Terranigma and Rendering Ranger/Targa for USA.
It's important to remember that "reproduction" is never anything more than an euphemism for bootleg, though. Which is why I find the whole Nintendo Age LE Bootleg Numbed Editions™ so distasteful.
So... should we place bets as to how many years it'll take until this rom hits net for true preservation? I want to say more then 2 years, but will say 2 years as a good luck charm.
