    Gamestop's motion to dismiss used game lawsuit denied


    What's happening is that Gamestop has been trying really hard to push of used games to customers. Gamestop was telling there customers that buying used game would be cheaper and they would still get all the DLC stuff like if the game was new. That ended up being bullshit. When the folks got home, the codes wouldn't be there for the DLC stuff and at the end, the game ended up costing more used than new for it.

    Well if Gamestop is saying that the DLC comes with the pre-owned game and it doesn't, then it is false advertisement and the courts logically will fine Gamestop for it. Unless of course, it is in small print that pre-owned copies might not come with DLC. That itself is a gamble, a pre-owned game might have the DLC code, it might not, it depends on whether the previous owners used the code up or not. Take an example, last year I bought myself a second hand copy of Need for Speed: Hot Pursuit Limited Edition on the PS3 [since I knew that the Limited Edition is slightly more complete and was pre-order only] from Blockbuster [now gone] for £8 and to my amazement, the code was not used and so I claimed it.

    Same thing if you buy pre-owned/second hand games from Game or Grainger Games in the UK, they try to push for the preowned game since they make more profit from that of a new game and I don't recall them mentioning any DLC but its been ages since I bought a pre-owned game and ones that I did buy didn't have stuff like that [except the example above] so not sure. I know at one time Game put a XBL/PSN voucher on second-hand copies of Call of Duty Black Ops 2 for the season pass. Grainger Games is even worse since some second hand games have been the American version [sometimes putting a poor PEGI sticker over the ESRB rating] instead of the UK/European version and they have been advertised as new so apparently the UK Trading Standards is getting involved for false advertisement. CeX is a place that just sells second hand goods of varying quality [from good to very very poor] but they mention that the product may not contain season passes or DLC on posters in stores and online.

    Then again apart from Game of the Year editions of games, are there any games that have DLC to be complete on a retail version anyway? [it is a rhetorical question]

    You know I actually asked a Gamestop salesperson about this coincidentally last week. It pertained to an online pass, which most publishers have done away with on current gen. games. He said that the games which were requiring purchase of the pass were priced much lower at GS as a result. I'm figuring they didn't do similar pricing on DLC.

    I don't know, the courts sided with Sony on the Other OS stuff, because it wasn't advertised basically on the packaging.

    I kinda see this sadly falling through.
