Maybe under Dutch law, in regards to intellectual copyright, but what is true in Holland certainly will not transfer elsewhere, unless of course it's European Law.
The © and date are often required as copyright only spans for a certain number of years and varies depending upon product.

me wanting to PLAY THEIR GAME is a taking a crap on them? Not everyone on the net has money or a job ya know. Even if I did the game would probably be sold out.
I just hope that after it is all said and done the rest of the gamers that were not as fortunate to get the game get a chance to play it with either a longer Demo of the ROM or a full release long after the game has been sold out.

Oh, it's no problem that you want to play their game. It's just that you want to play their game for free after spending years of time and money on the project is why people here are frothing at the mouth, and rightly so.
Or you could, you know...
1) Save up money for when/if they ever do a second print run.
2) Pirate some SNES jRPG instead. Perhaps a fan translated Japanese Square RPG like Live A Live or Treasure Hunter G.
Yeah Im just gonna play the tons of translated NES, SNES and other Genesis games till they upload it eventually years from now
