It can happen. Remember that Sonic Spinball had to have its title music changed at the last minute because the developers assumed they had the rights to use the original Sonic music and didn't check. It was rumoured that Sonic Chronicles ran into the same problem years later too. The design team probably designed a level based around Thriller but didn't think to check the clearances given that it's such an iconic "Jackson" song.
That bits were left in the Rev 0 ROM could suggest that they discovered the problem very late in development, probably after testing had finished.
It could also be that they were in negotiations and the whole thing fell through at last minute.
So when can we get this into the VGM Player?![]()

OFF: one thing that i never undertood about this game is why they put a full animation set of the kid from the movie in the Cartridge and just used it in the ending... I always trought that they planned to make him the second player...

Oh, I know who Bubbles is during the game. I figured they just dressed him up and had him dance for a bit of a silly ending as Sega liked to do back then. As you note, if that's a kid from the movie, he doesn't appear anywhere else in the game. It makes sense to me for that to be Bubbles just dressed in that style. Regardless, the ending is pretty lackluster, and it's a wonder why Sega made every kid use the same Katy sprite.
The composer of the first two Sonic Genesis games was part of a band called Dreams Come True, which are credited in the second game. I want to say some early copies of Spinball had the title music before they re-did it, but don't quote me on it. I'm guessing it's similar to a license. Speaking of Jackson, there was some issues with GTA Vice City when it made it to phones about his music being used, which was in the original versions on PS2, Xbox, and PC. Not sure if Rockstar paid for it.
OFF Part II: There's an interesting comment about this game made by Kellie Parker, the little girl from the Movie/game, Kellie and MJ played the game in the Neverland:

Sonic Spinball team were partying it up for finishing the final build before it went to the presses, when some Japanese dude from Sonic Team at the party was like "Oh, cool, so you guys got the rights to use that Dreams Come True tune?" Or something along those lines, then the music guy split in a puff of smoke to his music room to very quickly perform and add a new title screen tune as the build had to be sent like that night or morning.
Apparently US Sonic Team didn't know they didn't have the rights to Sonic 1 and 2 music.
Title screen, getting an emerald and game over music had to be changed, yeah. And the new title screen was composed in 30 minutes (I recall Drossin bringing this up during an IRC interview).
